These general terms and conditions (or terms of use), hereinafter also referred to as this contract, are concluded between the operator of the app "Loc.all", Trojer Rosa Maria with registered office in 39040 Kurtatsch, Maria Hilf 14/A, tax number TRJRMR70R70I431B and the respective user of this app.
Product description
Loc.all is an app for mobile IOS and Android smartphones, through which the respective user can easily network with other users and the respective municipality under the aspects of sustainability and community. Information published by the municipality or associations on the municipality pinboard (events, surveys, notifications regarding construction work taking place within the municipality and in neighbouring municipalities, etc.), a lost & found section, a virtual marketplace for the local sale of goods, as well as a help platform by means of which the user can offer services to other users or accept the services of other participants are available. In addition, an in-app chat is available, which enables users to contact other users directly and immediately and thus to initiate an exchange quickly and in a targeted manner. Particularly important messages and messages concerning the app for updating, etc. are sent to the users by means of push messages, the administration of which is the responsibility of the user.
Contract acceptance
Joining the App loc.all is only possible and permitted if these Terms and Conditions are accepted and confirmed in full. If the operator of the service detects violations of this contract, it may immediately carry out the deletion of the user account in question.
In addition, the use of the product may be temporarily suspended if the user does not comply with the general community standards for the use of social networks, as well as those arising from this contract. The decision to suspend and/or terminate/delete the account in the event of a violation of these terms of use or other material rules referred to by the operator of the app in question lies exclusively within the competence of the app operator, without prejudice to the applicable legal provisions. Any objections regarding the suspension, termination or deletion of an account may be sent to the operator by email to lokalvernetzt@gmail.com.
Users can also carry out the automated, complete deletion of their account themselves.
Due to changes in the law or other necessary adjustments to the scope of this contract, the responsible party may make changes to it. In the event of a material change to the rights and obligations to which you are entitled, you will receive a corresponding notification to your user account or e-mail in a timely manner. In this regard, users are advised to read the latest version of these Terms of Use, which can be found in the correspondingly marked location in the app. If the user does not agree with the changes, he/she can delete his/her account at any time.
Minimum age and eligibility
Users who reside in Southtyrol (Italy) that are at least 14 years of age in accordance with Legislative Decree No. 101/2018, are eligible to participate in the services of the loc.al app, without prejudice to the respective national and international laws and regulations of the areas of application not mentioned herein. Users under the age indicated must obtain authorisation from their parents, which must be sent to lokalvernetzt@gmail.com and approved by the operator.
Declarations by the user
By accepting this Agreement, you represent that: a) you are entitled to participate in App loc.all by virtue of the applicable national laws of your country of residence or domicile, as well as the international laws of the European Union or the territory that applies to you; b) you will absolutely refrain from causing any unforeseen, criminal, unfair or otherwise illegal and unacceptable conduct through App loc.all.
The following activities, listed in an exemplary and non-exhaustive list, are among the unlawful acts:
- use of the app for unlawful acts and purposes;
- unauthorised direct or indirect advertising, in particular by continuously writing to other users;
- use of personal data for commercial or unlawful purposes;
- using the app to commit a criminal offence according to the relevant legal system;
- carrying out threats, intimidation, blackmail or the like;
- violating data protection, copyright and/or trademark rights;
- posting content that incites violence, glorifies violence or shows sexual, pornographic or nude images;
- post contents which are racist and/or inflammatory towards groups or individuals;
- use another member's account or create multiple accounts;
- create a new account after the deletion/cancellation of an account, subject to the consent of the operator.
Cost of the product and possible subscriptions
The use of the Loc.all app is free of charge for the individual user (physical or legal person) and enables all users to offer and receive services within the app, as well as to use the marketplace of the app as a sales and acquisition space and, in addition, to post contributions on the community pinboard, whereby associations can post contributions in all areas of the pinboard, while citizens can participate in surveys created and create contributions themselves in the pinboard category Lost & Found.
The costs, expenses, etc. for the municipalities joining the network are regulated by a separate contract.
Use of personal data
The loc.all app is a social network that requires a user account to be set up. The user provides his or her first and last name (clear name), e-mail address, location (municipality) and tax number. Providing a telephone number and uploading a profile picture are optional. For the other users of the platform, only the name of the account holder and the profile picture (if available) are visible and, if desired by the account holder, also the email address and the telephone number.
Copyright and trademark rights
The user must comply with all regulations relating to the applicable laws of trademark and copyright law. The intellectual property of Rosa Maria Trojer may only be used or passed on with the written confirmation of the operator.
Disclaimer of the operator
The operator is expressly exempted from any liability towards third parties in the event that damages or other claims provided for by the relevant legal system arise due to unlawful use on the part of the respective account holder. If the account holder suspects or already knows that someone has gained unauthorised access to his/her account, this must be reported to the operator immediately after it becomes known, to the e-mail address lokalvernetzt@gmail.com.
Each user is responsible for the content of his/her account. If contents of other users are discovered, which violates this contract or offends common decency, this must also be reported immediately to the operator via the above-mentioned contact.
Privacy policy
The operator pays close attention to compliance with the privacy regulations in accordance with the Basic Data Protection Regulation EU No. 679/2016 and the gvD No. 101/2018 (Italy) and refers in this regard to the corresponding privacy policy.
Final provisions
The place of jurisdiction for any actions arising from this contract is Bolzano/Italy, without prejudice to the applicable legal provisions for consumer protection from the relevant EU regulations and the international law.
The laws of the Italian legal system apply, without prejudice to any other legal provisions.
If any provision of this contract is deemed invalid, this shall not affect the validity of the remaining provisions. The provision in question shall then be interpreted in such a way that it comes as close as possible to the invalid version.
The account created with loc.all is non-transferable and terminates in the event of the user's death. The respective account will be deleted after a notification with an attached proof of the truthfulness of the information.
The legally valid version of these Terms of Use is the one in German language.
